Terms of Service

These Terms of Service ("Terms") govern your access to and use of the mobile application Sediment (the "Service") provided by DongNe ("we", "us", "our"). By using the Service you agree to these Terms and our Privacy Policy. If you do not agree, please stop using the Service.

1. The Service

Sediment is a digital journaling service that lets you record short fragments — text and photos — and have AI weave them into weekly, monthly, quarterly, and yearly summaries (layers).

The Service is provided as a tool for self-understanding and reflection. It is not a substitute for medical, psychological, legal, or financial advice. If you are experiencing a crisis or need professional help, please contact a qualified professional or emergency services in your area.

2. Accounts

2.1 Anonymous mode

You may begin using the Service immediately without sign-up via anonymous mode. Anonymous accounts are tied only to a token stored on your device. If you lose the device or uninstall the app without linking an account, your data may be unrecoverable.

2.2 Linked accounts

You may link your anonymous account to a permanent account using Apple ID, Google account, or email/password. Linking preserves all your existing data.

2.3 Age requirement

You must be at least 13 years old (or older where required by your local law — for example, 14 in Korea, 16 in some EU countries) to use the Service. We may delete accounts and data we discover to belong to younger users.

2.4 Security

You are responsible for keeping your authentication credentials safe. We are not liable for losses caused by your failure to maintain that security.

3. Your Content

3.1 Ownership

All fragments, photos, and AI-generated layers belong to you. We process them only as needed to provide the Service.

3.2 License you grant us

You grant us a non-exclusive, royalty-free, revocable license to:

Store, transmit, and display your content as part of the Service
Send your text fragments to Google Gemini at the moment you request a layer

This license terminates immediately when you delete the content or your account. We do not use your content for advertising, promotion, or any disclosure outside the Service.

3.3 Prohibited uses

You agree not to:

Post content that infringes others' intellectual property, privacy, or reputation
Post unlawful content (child sexual abuse material, incitement to violence, drug trafficking, etc.)
Reverse-engineer, automate abusive volumes of requests, or bypass security
Attempt to access other users' accounts or content without authorization

We may remove content and suspend accounts in violation, with or without prior notice.

4. AI Layers

4.1 Nature of AI output

Layers are observational summaries generated by Google's Gemini model from your fragments. We do not guarantee accuracy, completeness, or usefulness. Layers are not advice and should not replace your own judgment.

4.2 Data flow

Your text fragments are transmitted to the Gemini API only at the moment you request a layer. Google processes that data under its own policies. We do not retain it separately.

5. Subscriptions (Sediment Pro)

5.1 Free use

Every user receives 50 credits per month at no charge. Credits are consumed when generating AI layers and reset on the 1st of each month.

5.2 Pro subscription

You may subscribe to Sediment Pro for unlimited layer generation. Plan options and prices are shown in the in-app subscription page. Payments are processed by Apple App Store or Google Play.

5.3 Auto-renewal

All subscriptions renew automatically. If you do not cancel at least 24 hours before the next billing date, the subscription renews at the same terms.
If we change prices, we will notify you in advance. If you do not cancel before renewal, the new price applies.

5.4 Cancellation

You can cancel anytime under "Manage Subscription" in App Store or Google Play.
After cancellation, Pro benefits remain active until the current period ends.

5.5 Refunds

Auto-renewing subscription refunds are subject to Apple's and Google's refund policies.
EU / UK / Swiss residents: you have a 14-day right of withdrawal under EU consumer law (Directive 2011/83/EU). However, by starting to use the digital service before the 14-day period expires (e.g., generating an AI layer), you acknowledge that you waive the right of withdrawal for content already used.
California residents: you may request a refund within the time period stated in Apple's or Google's policy.
Credits already consumed for AI generation are non-refundable.
Refund requests must be submitted to Apple or Google directly. We have no authority to override their decisions.

6. Account Deletion

You may permanently delete all your data via Account → "Delete account permanently" in the app.

If you have an active subscription, deletion is blocked until you cancel it via App Store or Google Play.
Deletion is irreversible. Already-consumed credits are non-refundable.

7. Disclaimers and Liability

7.1 As-is service

The Service is provided "AS-IS" and "AS-AVAILABLE." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.

7.2 Limitation of liability

To the maximum extent permitted by law, our cumulative liability for any claim arising from or related to the Service is limited to:

For paying users: the amount you paid us in the 12 months preceding the event giving rise to the claim
For free users: USD 50 or equivalent

We are not liable for:

Accuracy or usefulness of AI output
Outages or failures of third-party services (Apple, Google, RevenueCat)
Loss caused by your device being lost, stolen, or compromised
Force majeure (natural disaster, war, network outage, etc.)

7.3 Consumer rights

Nothing in these Terms limits any non-waivable consumer rights you may have under your local law.

7.4 Apple-specific (for iOS users)

You acknowledge that these Terms are between you and us, not Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support, and no warranty obligations. In the event of any conflict between these Terms and Apple's Licensed Application End User License Agreement, the Apple terms govern.

8. Changes to these Terms

We may modify these Terms. We will notify you at least 7 days before changes take effect. For changes that materially reduce your rights, we will give 30 days' notice. If you do not agree, you may stop using the Service and delete your account.

9. Governing Law and Disputes

These Terms are governed by the laws of Republic of Korea, without regard to conflict-of-law principles. Disputes are subject to the exclusive jurisdiction of Seoul Central District Court.

For consumers in jurisdictions where mandatory consumer-protection laws apply (e.g., Korea, EU), those laws prevail to the extent they conflict with this section.
